1. Scope
This Refund and Returns Policy applies to eligible products and services purchased directly from EastCarson.com, which is owned and operated by Cydewalk Media LLC, a Pennsylvania limited liability company (“Cydewalk Media,” “EastCarson,” “we,” “us,” or “our”).
Different terms may apply to physical merchandise, directory listings, advertising, sponsorships, subscriptions, digital services, and purchases fulfilled by third parties. Terms displayed during checkout or contained in a specific written order may supplement this Policy. If a specific written agreement conflicts with this Policy, the specific written agreement controls to the extent permitted by law.
2. Purchases from Third Parties
EastCarson may link to restaurants, retailers, ticket sellers, delivery services, affiliate partners, advertisers, and other independent businesses. Purchases made on an external website are transactions between the purchaser and that third party.
Returns, refunds, cancellations, delivery issues, reservations, warranties, and disputes involving an external purchase are governed by the third party’s policies. EastCarson does not receive or control the purchase funds merely because a visitor reached the third party through an EastCarson link.
3. Physical Merchandise Purchased Directly from EastCarson
Unless a product is identified as final sale or subject to different written terms, a customer may request authorization to return eligible physical merchandise within 30 days after confirmed delivery.
To qualify, merchandise must generally be unused, unworn, unwashed, undamaged, and returned with its original packaging, accessories, tags, and proof of purchase. EastCarson may reasonably inspect a returned item before approving a refund.
The following items are not returnable except where required by law:
- Personalized, customized, or made-to-order products.
- Gift cards or promotional credits.
- Downloaded or delivered digital products.
- Products damaged through misuse, neglect, alteration, improper care, or ordinary wear.
- Items designated as final sale before purchase.
- Items that cannot be safely resold for health, sanitation, or security reasons.
Do not mail an item without authorization. Submit a request through the EastCarson Contact page and include the order number, item, reason for the request, and photographs if the item arrived damaged or incorrect. Approved return instructions and the applicable return address will be provided privately.
The customer is responsible for ordinary return-shipping costs unless the item was materially defective, damaged before delivery, or incorrectly fulfilled by EastCarson.
4. Damaged, Defective, or Incorrect Merchandise
If physical merchandise purchased directly from EastCarson arrives materially damaged, defective, or different from the item ordered, contact us promptly and provide the order number and reasonable photographic evidence.
After verification, EastCarson may provide an appropriate replacement, repair, store credit, or refund. Cydewalk Media will be responsible for reasonable authorized return-shipping costs arising from a verified EastCarson fulfillment error.
Damage caused after delivery by misuse, alteration, improper storage, neglect, or ordinary wear is not considered a fulfillment defect.
5. Listing, Advertising, Sponsorship, and Digital Services
Fees for listing upgrades, featured placement, sponsored placement, spotlight placement, advertising, creative preparation, digital services, or other work that has already begun or been delivered are generally nonrefundable to the extent permitted by law.
Before fulfillment begins, EastCarson may consider a cancellation request individually. Approval is not guaranteed. An approved refund may be reduced by disclosed payment-processing charges, nonrecoverable third-party costs, and the reasonable value of work already completed when permitted by law.
The failure of a promotion, advertisement, listing, or sponsorship to produce a particular number of views, clicks, leads, customers, sales, or profits is not by itself grounds for a refund unless EastCarson expressly guaranteed that result in a signed written agreement.
Nothing in this section limits a remedy required for services that were not delivered, were materially misrepresented, or otherwise qualify for relief under applicable law.
6. Subscriptions and Recurring Charges
A subscription continues and renews according to the terms presented at enrollment until canceled. Cancellation prevents future renewals after the effective cancellation date but does not automatically refund a charge already incurred.
Subscription fees already charged are nonrefundable and are not prorated, except where required by law or expressly stated in a written offer. Cancellation does not retroactively eliminate fees for services or placement already provided.
Customers are responsible for canceling before the next renewal date. EastCarson will provide a reasonable cancellation method through the customer account, the applicable subscription workflow, or the Contact page.
7. Refund Processing
Approved refunds will generally be issued to the original payment method within 5–10 business days after approval or receipt and inspection of an authorized return, as applicable.
Financial institutions and payment providers may require additional time to post a refund. EastCarson does not control a bank’s or payment provider’s processing schedule.
Original delivery charges, expedited-shipping charges, completed third-party services, and other nonrecoverable charges are nonrefundable unless required by law or the refund resulted from a verified EastCarson fulfillment error.
8. Chargebacks and Payment Disputes
Customers should contact EastCarson before initiating a payment dispute so we have a reasonable opportunity to investigate and resolve the matter. This request does not waive any nonwaivable right to dispute an unauthorized or legally contestable charge.
Fraudulent chargebacks, false claims, or abuse of refund procedures may result in suspension of accounts, listings, services, or future purchasing privileges and may be contested using relevant order, delivery, access, communication, and transaction records.
9. Pennsylvania Consumer Protection
This Policy is intended to operate consistently with applicable Pennsylvania law, including the Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 P.S. § 201-1 et seq. Nothing in this Policy excludes, limits, or waives a consumer right or remedy that cannot lawfully be excluded, limited, or waived.
10. Governing Law and Venue
To the fullest extent permitted by law, this Policy and disputes arising from purchases made directly through EastCarson are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
Any legal proceeding that may lawfully be restricted to a particular forum shall be brought in a court of competent jurisdiction located in Allegheny County, Pennsylvania. This section does not deprive a consumer of a mandatory protection or forum provided by applicable law.
11. Severability, Reservation of Rights, and No Waiver
If any provision of this Policy is found unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
EastCarson reserves the right to deny a request that does not satisfy this Policy, appears fraudulent or abusive, or concerns a transaction for which EastCarson was not the seller, except where applicable law requires otherwise. Failure to enforce a provision does not waive the right to enforce it later.
We may revise this Policy prospectively. The version in effect when a direct purchase was completed will ordinarily govern that transaction unless applicable law requires otherwise.
